These Terms of Service ("Terms") govern your use of DermaId (the "Service", "Platform", "we", "us") as an individual consumer — someone who creates an account, uses skin analysis, manages a routine, purchases products, or communicates with a specialist. A separate set of Terms governs clinics, their staff, and marketplace vendors — see /en/pages/terms/clinics-vendors. Our data practices are described separately in /en/pages/privacy and /en/pages/data-handling, both incorporated into these Terms by reference.
1. Acceptance of these Terms
By creating an account, browsing the marketplace, or otherwise using the Service, you agree to these Terms in full. If you do not agree, you must not use the Service. If you are using the Service on behalf of someone else (for example, a minor in a jurisdiction where that is permitted with guardian consent), you represent that you are authorized to accept these Terms on their behalf.
2. Who we are
Company legal information — registration details still outstanding See /en/pages/privacy §1 for the required fields (legal name, registration number, VAT number, registered address, contact). The same legal entity is the counterparty to these Terms.
3. Eligibility
You must be at least 16 years old to create an account or use the Service, consistent with /en/pages/privacy §11. Where you register with an email and password, you confirm this at registration. Where you sign in through a third-party identity provider that does not collect a birthdate, we require a separate confirmation the first time you attempt to book a consultation or reach a human specialist. Creating an account under a false age, or on behalf of a person who does not meet this minimum, is a breach of these Terms.
4. The Service — cosmetic guidance only, not medical advice
This is critical and applies throughout these Terms. The Service provides cosmetic skincare guidance based on photographs and information you provide. It is not a medical device. It does not diagnose, treat, cure, or prevent any disease or medical condition, and nothing in the Service constitutes medical advice. Skin-analysis results, routine recommendations, and answers from the AI assistant are cosmetic guidance only, generated in part by automated processing, and may be inaccurate or incomplete. If you have a medical concern about your skin — including anything that looks unusual, painful, rapidly changing, or that a reasonable person would have examined by a professional — consult a qualified healthcare provider. Do not delay or forgo medical care because of anything the Service tells you.
5. Your account
You must provide accurate registration information and keep it up to date. You are responsible for safeguarding your password and for all activity under your account. Notify us immediately of any unauthorized use. You may hold one personal account; a customer account and a clinic-staff account are kept as separate identities even if the same person holds both (see /en/pages/data-handling §2). We may require additional verification (such as two-factor authentication) for certain actions.
6. Skin analysis
When you use the skin-analysis feature, you upload or capture a photograph that is processed, using a third-party AI vision service, to generate cosmetic concern scores. Requires your separate, explicit consent before your first analysis (see /en/pages/privacy §3.3). Results are automated, may vary between analyses of the same skin, and are not a substitute for a professional assessment. You control your photo retention setting and may delete a photograph or your account's analysis history at any time, as described in our Data Handling Policy.
7. The AI assistant and a human specialist are separate services
Chatting with our AI assistant is included with certain plans (see §10); it is an automated conversational tool, not a person, and its answers are cosmetic guidance only, subject to §4. Reaching a human specialist is a materially different thing: a real person, employed or engaged by a clinic — never by the Platform directly — who may review your information and respond to you. These are two separate, non-overlapping conversations, and nothing said in one is shown in the other except a routine you explicitly choose to send across (see /en/pages/privacy §3.6). Consultations delivered by a specialist are the clinic's professional service; the clinic, not the Platform, is responsible for the professional and clinical content of that advice. We do not employ, supervise, or vouch for the clinical judgment of any specialist — our role is limited to providing the technology that connects you.
8. Consultations and appointments
Where a clinic offers appointments, booking is subject to that clinic's availability and confirmation; a requested slot is not guaranteed until confirmed. Consultations are delivered as text chat or in person, as offered by the clinic — not by video or voice call. Cancellation, rescheduling, and no-show terms are set by the clinic you are booking with; check with the clinic directly for its specific policy. [Legal review note: confirm whether a platform-wide minimum cancellation-notice standard should be imposed on all clinics, or left entirely to each clinic's own policy as currently described.]
9. Marketplace purchases
9.1 Multi-vendor marketplace
Products in the marketplace are sold by independent vendors or by a clinic selling its own stock — the Platform operates the marketplace and processes payment on the seller's behalf, but is not itself the seller of record for a third party's goods except where a product is explicitly listed by the Platform's own house clinic. A single order may include items from more than one seller; each seller is responsible for the accuracy of its own listings, stock, and fulfillment of its own items.
9.2 Guest checkout
You may purchase without creating an account. A guest order is tied to the contact and shipping details you provide at checkout rather than to an account, and account-only features (order history across sessions, wishlist, personalized recommendations) are not available for guest orders.
9.3 Pricing, currency, and availability
Prices are shown in the currency applicable to your resolved market and may vary by country due to regulatory, tax, or logistics differences. A product may be restricted to certain markets due to ingredient regulations in your country. We reserve the right to correct a pricing or listing error before an order is fulfilled; if an error is discovered after payment, we will notify you and offer a correction, substitute, or full refund of the affected item.
9.4 Payment
Payment is processed by our payment provider (Stripe); we do not store your full card number (see /en/pages/privacy §3.4, §6). For Syria, payment is cash-on-delivery only, consistent with international sanctions restrictions — see §16.
9.5 Returns and refunds
[Legal review note: a concrete returns/refund policy — return window, condition requirements, who bears return shipping, and any exceptions for opened cosmetic products for hygiene reasons — must be drafted and inserted here before publication. This is a materially incomplete section as written.]
9.6 Reference-library products
Some products are listed for informational reference only, are clearly labeled as such, and cannot be purchased through the Service.
10. Subscriptions and billing
10.1 How billing works
Certain features (for example, unlimited skin analyses, AI-assistant access beyond a free quota) require a paid subscription, billed on a recurring basis until cancelled. By subscribing, you authorize us to charge your payment method on each renewal at the then-current price for your plan, unless you have stopped auto-renewal before that date.
10.2 Free plan
Our free plan includes a limited allowance that, for the individual free plan specifically, is granted once rather than renewing every billing period — check your plan's specific terms on the pricing page, as this differs from paid plans, whose allowances renew each period.
10.3 Cancelling auto-renewal
Cancelling means your plan will not renew after the period you have already paid for — it does not refund the current period and does not end your access immediately. You keep your plan's benefits until the end of the period you paid for, after which the account reverts to the free plan (or lapses, if no free tier applies). You may cancel or resume auto-renewal at any time from your account settings, and doing so remains reversible up until the date on which it takes effect.
10.4 Changing plans
Upgrading to a more expensive plan takes effect immediately; you are charged the prorated difference for the remainder of your current billing period. Downgrading to a less expensive plan takes effect at the end of your current, already-paid-for period, and you may cancel a pending downgrade before it takes effect. Choosing any new plan supersedes a previously scheduled cancellation.
10.5 No partial refunds
Except where required by law or expressly stated otherwise, subscription fees are non-refundable for the remainder of a billing period once that period has begun.
11. Consent and how we handle your data
Your use of features involving special-category data (skin-analysis photographs, health-related questionnaire answers) is governed by the consent mechanisms described in /en/pages/privacy, which you must separately grant before those features become available to you. These Terms do not themselves constitute that consent.
12. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose, or to violate any applicable law or regulation;
- Upload a photograph of anyone other than yourself without that person's informed consent;
- Attempt to reverse-engineer, scrape, or interfere with the Service's normal operation, including automated data collection beyond what a feature expressly permits;
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
- Submit false, defamatory, or infringing content, including in product reviews;
- Use the AI assistant or a specialist consultation as a substitute for professional medical care in a situation that warrants it (see §4);
- Circumvent, disable, or otherwise interfere with any security feature of the Service.
We may suspend or terminate an account that violates this section, as described in §18.
13. Content and intellectual property
The Service, including its software, design, text, and branding (excluding third-party product names, trademarks, and vendor-supplied content, which remain the property of their respective owners), is owned by us or our licensors and protected by intellectual property law. You retain ownership of content you submit (photographs, questionnaire answers, messages, reviews) but grant us a license to use it as necessary to operate the Service for you — for example, to generate your analysis, display your review, or share a routine you choose to send to a clinic.
14. Reviews
You may submit a product review if you have a genuine basis to do so. We do not create, seed, or display fabricated reviews or ratings — a product with no reviews shows none, rather than a placeholder rating. A review that is false, unlawfully defamatory, or submitted in bad faith may be removed.
15. Third-party services and content
The Service relies on third-party providers — including our AI vision and chat provider, payment processor, and, for supplementary product data, open datasets such as Open Beauty Facts — some of which are used on a best-effort basis and may be unavailable or inaccurate from time to time. We are not responsible for the accuracy, availability, or content of third-party services, though we take reasonable steps to select and monitor the providers we rely on.
16. Region-specific terms
- Sweden / European Economic Area. These Terms and the Service are designed to operate consistently with applicable EU/Swedish consumer- protection law. [Legal review note: confirm statutory withdrawal-right language required for EU distance sales is fully reflected in §9.5 once drafted.]
- Gulf Cooperation Council countries. [Legal review note: consumer- protection and e-commerce regulations differ by jurisdiction across the Gulf and must be reviewed by locally licensed counsel before the Service processes orders for residents of a given country.]
- Syria. Syria is subject to comprehensive international sanctions. Payment for orders in Syria is cash-on-delivery only; no online payment processor is used for Syrian transactions, consistent with /en/pages/privacy §15.
17. Disclaimers
To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that skin-analysis results or AI-generated content will be accurate, complete, or suitable for your particular skin. Nothing in this section limits any right you have under mandatory consumer-protection law that cannot lawfully be excluded.
18. Limitation of liability
To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the Service. [Legal review note: a specific liability cap (e.g., amounts paid in the preceding 12 months) is standard practice and should be inserted here following counsel's review — deliberately left unquantified in this draft rather than guessed at.] Nothing in these Terms limits liability that cannot lawfully be limited, including liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded under applicable consumer-protection law.
19. Termination
By you. You may stop using the Service and delete your account at any time from your account settings — see /en/pages/data-handling §9 for exactly what happens to your data when you do.
By us. We may suspend or terminate your account if you violate these Terms, including §12, or where required by law. Where reasonably possible, we will provide notice before termination; where a violation poses an immediate risk (fraud, abuse, safety), we may act without prior notice. Sections that by their nature should survive termination (including §13, §17, §18, and §20) continue to apply.
20. Governing law and dispute resolution
[Legal review note: governing law and forum/dispute-resolution mechanism (courts vs. arbitration, and which jurisdiction) must be specified by counsel before publication — deliberately left open here rather than defaulting to a jurisdiction without review, given the Service's multi-region footprint (Sweden, Gulf countries, Syria).]
21. Changes to these Terms
We may update these Terms from time to time. We will post the updated version with a new "Last updated" date and, for material changes, take reasonable additional steps to notify you before they take effect. Continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.
22. General
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. Our failure to enforce a provision is not a waiver of our right to do so later. These Terms, together with our Privacy Policy and Data Handling Policy, constitute the entire agreement between you and us regarding the Service.
